Give & Go will NEVER notify winners via social media direct message, including Instagram DMs, Facebook Messenger, TikTok DMs, or any other social platform. Winners are contacted exclusively by the Give & Go team via the email address and phone number provided at the time of entry. If you receive a message on social media claiming you have won a Give & Go sweepstakes, it is a scam. Block and report the account immediately.

Give & Go will NEVER ask you to pay any fee, tax, shipping charge, or any other amount to claim your prize. Prize fulfillment is handled entirely by Give & Go at no cost to the winner. Any request for payment to claim a prize is fraudulent.

Section 1
Operator & Sponsor

All sweepstakes campaigns published on the Give & Go platform (giveandgo.com) are operated and sponsored exclusively by Give & Go (the "Operator," "Sponsor," "we," "us," or "our"), a company organized and operating under the laws of the United States of America.

The participating 501(c)(3) nonprofit organization named on each campaign page (the "Beneficiary Organization") is the designated recipient of the fundraising proceeds generated by that campaign. The Beneficiary Organization is not the operator, sponsor, or administrator of the sweepstakes and bears no legal responsibility for sweepstakes administration, prize fulfillment, or compliance with applicable sweepstakes laws.

Give & Go specializes in serving IRS-recognized 501(c)(3) nonprofit organizations, and also welcomes all other qualifying fundraising causes including booster clubs, community groups, athlete-sponsoring organizations, pre-501(c)(3) organizations, and other nonprofit causes that do not yet hold formal 501(c)(3) status. The specific type of Beneficiary Organization is identified on each campaign page.

Important: Entry fees paid on the Give & Go platform are payments to Give & Go for participation in a lawful sweepstakes. They are not charitable donations and are not tax-deductible as charitable contributions under federal or state law.
Section 1B
Sweepstakes Structure & Licensing

Give & Go campaigns are structured and operated as sweepstakes โ€” not as lotteries, raffles, or games of chance requiring consideration. Under US federal and state law, the three elements that classify a promotion as an illegal lottery are: (1) a prize, (2) chance, and (3) consideration (payment). By providing a genuine, equally accessible no-purchase-necessary alternative method of entry, Give & Go eliminates the consideration element, and all campaigns are therefore lawfully classified as sweepstakes.

No gambling license is required โ€” by Give & Go as the operator, by the 501(c)(3) beneficiary organization, or by any sponsoring entity โ€” because Give & Go campaigns are sweepstakes, not lotteries or raffles. This applies to all of the following:

  • 501(c)(3) nonprofit organizations โ€” schools, churches, veterans organizations, foundations, youth sports clubs, and all other IRS-recognized charitable organizations
  • Charitable causes and foundations โ€” organizations raising funds for medical, educational, arts, or community purposes
  • Organizations sponsoring athletes or students โ€” booster clubs, travel sports teams, national training centers, and organizations raising funds to support individual athletes, Olympic hopefuls, or students โ€” even if not yet formally incorporated as a 501(c)(3)
  • Pre-501(c)(3) organizations โ€” community groups, clubs, and organizations that are in the process of obtaining 501(c)(3) status or operating as informal nonprofit entities
  • Give & Go as the sweepstakes operator โ€” operating a sweepstakes with a legitimate NPNE method does not constitute operating a gambling business under federal law or the laws of the 48 contiguous United States
Important legal note: The above reflects Give & Go's good-faith understanding of applicable federal and state sweepstakes law as applied to its specific NPNE sweepstakes structure. This is not legal advice. Sweepstakes and promotional laws vary by state and are subject to change. Give & Go strongly recommends that all beneficiary organizations and sponsoring entities consult qualified legal counsel regarding their specific circumstances. This section does not constitute a legal opinion or guarantee of compliance in any specific jurisdiction.

The sweepstakes structure described in these Official Rules โ€” including the no-purchase-necessary mail-in entry option described in Section 3 โ€” is specifically designed and maintained to ensure full compliance with federal and applicable state sweepstakes laws. Give & Go works with qualified sweepstakes legal counsel to maintain this compliance on an ongoing basis.

Section 2
Eligibility Requirements

Sweepstakes campaigns on the Give & Go platform are open to legal residents of the 48 contiguous United States and the District of Columbia who are at least eighteen (18) years of age, or the age of majority in their state of residence, at the time of entry. Void in Alaska, Hawaii, and all other states and jurisdictions where prohibited by law.

The following individuals are not eligible to enter or win any Give & Go sweepstakes:

  • Employees, officers, directors, members, agents, or independent contractors of Give & Go or any of its affiliated companies, subsidiaries, or advertising and promotional agencies
  • Officers, directors, trustees, or paid employees of the Beneficiary Organization named in the campaign
  • Immediate family members (defined as spouse, parent, child, or sibling, regardless of where they reside) or members of the same household as any of the above
  • Any individual residing in a state or jurisdiction where the sweepstakes is void or prohibited by applicable law

Give & Go reserves the right to verify the eligibility of any entrant or potential winner at any time and to disqualify any individual who does not satisfy these requirements or who has tampered with the entry process.

Section 3
How to Enter

NO PURCHASE OR PAYMENT OF MONEY IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR ODDS OF WINNING.

There are two methods of entry for each Give & Go sweepstakes campaign:

Method 1 โ€” Purchase Entry (Online)
During the campaign period, visit the active campaign page at giveandgo.com and purchase one or more entries at the posted per-entry price using the secure checkout. Each entry purchased equals one (1) entry in the campaign drawing pool. Multiple entries may be purchased in a single transaction. Entry fees are non-refundable except as required by law.

Method 2 โ€” Free Mail-In Entry
To enter without purchase, hand-print โ€” in legible block letters โ€” your full legal name, complete mailing address, email address, phone number, date of birth, and the specific campaign name on a plain 3" ร— 5" card or piece of paper. Insert the completed card into a standard #10 business-sized envelope with first-class postage affixed and mail to:

Mail-in entries must be postmarked no later than five (5) calendar days prior to the campaign close date and received within five (5) calendar days of the campaign close date. One (1) free entry per person per campaign per outer mailing envelope. Each valid mail-in entry equals one (1) entry in the campaign drawing pool โ€” the same as one purchased entry.

Mail-in entry requirements: The entry card and outer envelope must be entirely hand-printed by the entrant. Mechanically reproduced, photocopied, typed, or pre-printed entries will be void. Entrants may not use any third-party organization, service, or bulk mailing operation to submit mail-in entries. Non-compliant entries will be disqualified without notice.

Entry Limits: Regardless of entry method, no single individual may hold more than fifty (50) total entries in any single campaign. All entries โ€” whether purchased or submitted by mail โ€” are equal in the drawing pool, with each entry representing one equal chance of selection per draw.

Section 4
Campaign Periods

Each Give & Go campaign has a designated start date and end date displayed on the campaign page. All purchased entries must be completed and payment confirmed before 11:59:59 PM Eastern Time on the campaign close date. All mail-in entries must be postmarked no later than five (5) calendar days prior to the campaign close date and received within five (5) calendar days of the campaign close date.

Give & Go reserves the right to extend a campaign's close date if the minimum entry threshold described in Section 11 has not been met. Give & Go will announce any extension on the campaign page and via email notification to existing entrants.

Section 5
Prize Descriptions & Approximate Retail Values

Each campaign specifies one of the following prize tiers. Approximate Retail Values (ARV) are based on permanent peak season pricing and are fixed for the life of the campaign regardless of when the winner travels or which property they select.

One (1) Deluxe Resort View Suite for two (2) adults and two (2) children, seven (7) days six (6) nights, all-inclusive, at one eligible Palace Resorts property of the winner's choosing. Children ages 0โ€“17 stay free at properties participating in the current Palace Resorts Kids Free promotion. Winner also receives a $750 cash tax assistance gift from Give & Go, paid separately at time of prize fulfillment to help offset any applicable tax liability. Minimum 250 entries, maximum 400 entries.

๐Ÿ’ซ Platinum Tier Prize (ARV: approximately $15,000) + $1,500 Tax Assistance Cash Gift
One (1) Grand Governor Ocean View Suite for two (2) adults, seven (7) days six (6) nights, all-inclusive, at one eligible Palace Resorts property of the winner's choosing. Children ages 0โ€“17 may accompany the winner subject to resort availability and terms. Winner also receives a $1,500 cash tax assistance gift from Give & Go, paid separately at time of prize fulfillment. Minimum 250 entries, maximum 350 entries.

๐Ÿ’Ž Diamond Tier Prize (ARV: approximately $25,000) + $2,500 Tax Assistance Cash Gift
One (1) Grand Presidential Suite for up to six (6) guests (any combination of adults and children), seven (7) days six (6) nights, all-inclusive, at one eligible Palace Resorts property of the winner's choosing. Winner also receives a $2,500 cash tax assistance gift from Give & Go, paid separately at time of prize fulfillment. Minimum 250 entries, maximum 300 entries.

Suite type subject to availability. In the event the specified suite type is unavailable for the winner's selected dates and resort, Give & Go will offer a comparable or upgraded accommodation at the same or an equivalent Palace Resorts property at Give & Go's sole discretion.
Give & Go Peak Season Pricing โ€” Fixed for Every Campaign

All-inclusive resort pricing can fluctuate based on season, demand, and availability. To ensure consistency and protect the integrity of every campaign, Give & Go sets all prize costs using permanent peak season rates โ€” fixed at campaign launch and never adjusted, regardless of when the winner travels or what the actual fulfillment cost turns out to be.

The prize cost deducted before the 75/25 revenue split is permanently set at campaign launch. This fixed number is what Give & Go uses to pay for the prize. Both Give & Go and the Beneficiary Organization operate from that same fixed figure โ€” there are no adjustments up or down based on actual fulfillment costs or seasonal pricing changes.

In plain terms: the prize cost is fixed permanently at peak season rates at campaign launch. The Beneficiary Organization receives 75% and Give & Go receives 25% of net revenue after that fixed prize cost is deducted โ€” every time, with no exceptions and no adjustments.

What the prize includes: All meals at resort restaurants, unlimited beverages including premium open bar, 24-hour room service, resort pools and beach access, water park, fitness facilities, nightly entertainment, and all standard all-inclusive amenities as defined by the selected Palace Resorts property.

What the prize does not include: Round-trip transportation or airfare to and from the resort, travel insurance, personal expenses, spa treatment upgrades, golf green fees, off-property excursions, or any other expense not expressly included in the all-inclusive package. No cash equivalent or substitution is permitted except at Give & Go's sole discretion.

Section 6
Winner Selection

One (1) winner per campaign will be selected by randomized drawing from all eligible entries received during the campaign period. The drawing will be conducted by Give & Go or its designated sweepstakes administrator on or within seven (7) days following the campaign close date.

Each entry in the drawing pool โ€” whether purchased or submitted by mail โ€” represents one (1) equal and independent chance of being selected. An entrant holding multiple entries will have their identifier represented once for each valid entry held.

The complete entry list, including entrant names, number of entries held, and entry method, will be published on the campaign page no fewer than 48 hours prior to the scheduled drawing. The entry ledger is locked at campaign close and no entries may be added, removed, or altered thereafter.

The drawing will be conducted using a verified random selection process. Give & Go reserves the right to use a digital randomization tool, spinning wheel display, or other auditable random method. Live drawings will be broadcast and recorded, with the recording made available on the campaign page following the event.

Transparency commitment: Give & Go is committed to fully public, verifiable drawings. The randomization method and complete entry data are made available to any entrant upon written request within 30 days of the drawing date.
Section 7
Winner Notification & Verification

The selected potential winner will be notified by Give & Go via the email address and/or phone number provided at the time of entry within forty-eight (48) hours of the drawing. Give & Go will make three (3) contact attempts over five (5) business days.

The potential winner may be required to execute and return an Affidavit of Eligibility, a Liability Release, and where permitted by law, a Publicity Release, within ten (10) business days of notification. Failure to respond, failure to return completed documentation, failure to comply with these rules, or return of any prize notification as undeliverable may result in disqualification and selection of an alternate winner.

Give & Go will never notify winners through social media platforms. All winner communication is conducted exclusively via direct email and phone contact using the information provided at entry. See the Scam Warning above for details.

Section 8
Prize Fulfillment & Date Selection

Upon verification of eligibility and return of all required documentation, the confirmed winner will be granted access to the Give & Go Winner Portal. Through the portal, the winner must select their preferred Palace Resorts property and desired travel dates within thirty (30) days of receiving winner portal access.

Travel must be completed within twelve (12) months of the campaign close date. Blackout dates are displayed within the Winner Portal and include major holidays, peak periods designated by Palace Resorts, and dates with no confirmed availability. Give & Go will make reasonable efforts to accommodate the winner's preferred dates subject to resort availability.

Give & Go will send reminder notifications at day 20 and day 28 of the 30-day selection window. If the winner fails to select dates within the 30-day window, the prize will be deemed forfeited. No cash or alternative prize will be offered for a forfeited prize. Give & Go reserves the right to award a forfeited prize to an alternate winner or to return the prize to inventory at its sole discretion.

All prize bookings are processed directly by Give & Go. The winner does not pay any amount to claim or redeem the prize. Any person requesting payment to release a prize is engaged in fraudulent activity and should be reported to Give & Go immediately.

Section 9
Beneficiary Organization

Give & Go specializes in serving IRS-recognized 501(c)(3) nonprofit organizations. Give & Go also welcomes the following types of qualifying organizations as campaign beneficiaries:

  • 501(c)(3) nonprofit organizations โ€” verified IRS-recognized charitable organizations of all types
  • Booster clubs and athletic supporter organizations โ€” school booster clubs, travel sports organizations, and groups raising funds to support student athletes
  • National training centers and Olympic hopeful programs โ€” organizations supporting competitive athletes pursuing national or Olympic-level competition
  • Pre-501(c)(3) community organizations โ€” community groups, civic clubs, and organizations that are in the process of obtaining or have not yet obtained 501(c)(3) status
  • Other qualifying nonprofit causes โ€” as determined by Give & Go at its sole discretion on a case-by-case basis

The Beneficiary Organization receives a portion of the net campaign revenue as described in Section 10. This payment is a fundraising distribution from Give & Go to the Beneficiary Organization โ€” it is not a charitable contribution made by entrants. Entry fees paid to Give & Go are not tax-deductible as charitable contributions regardless of the Beneficiary Organization's tax-exempt status.

The Beneficiary Organization does not operate, administer, or bear legal responsibility for the sweepstakes. All sweepstakes operations, prize fulfillment, winner selection, and regulatory compliance are the sole responsibility of Give & Go.

Section 10
Revenue Distribution

Following the conclusion of each campaign and after deduction of the published prize retail value, Give & Go distributes net revenue as follows:

  • 75% of net revenue to the designated Beneficiary Organization
  • 25% of net revenue retained by Give & Go as the platform and operations fee

"Net revenue" is defined as total entry fee revenue collected during the campaign period, minus the prize retail value as published on the campaign page at time of launch. The Beneficiary Organization receives a detailed payout summary within five (5) business days of the campaign close date.

Give & Go Platform Fee โ€” Calculated on Minimum Ticket Sales

Give & Go's 25% platform fee is calculated based on the minimum required ticket sales for each campaign tier, regardless of whether total ticket sales exceed that minimum. Specifically:

ยท Gold Tier: Give & Go's 25% fee is calculated on the net revenue generated by the first 250 tickets sold ($25,000 gross โˆ’ $10,000 prize = $15,000 net ยท 25% = $3,750)
ยท Platinum Tier: Give & Go's 25% fee is calculated on the net revenue generated by the first 250 tickets sold ($50,000 gross โˆ’ $15,000 prize = $35,000 net ยท 25% = $8,750)
ยท Diamond Tier: Give & Go's 25% fee is calculated on the net revenue generated by the first 250 tickets sold ($62,500 gross โˆ’ $25,000 prize = $37,500 net ยท 25% = $9,375)

All ticket sales above the minimum threshold are split under the same 75/25 structure. Give & Go's 25% platform fee applies to all net revenue โ€” both at and above the minimum threshold. Every ticket sold contributes to the organization's 75% share and Give & Go's 25% share after the fixed prize cost is deducted.

How many tickets does each tier need to sell to cover Give & Go's 25% fee?

Give & Go's platform fee is fully covered by ticket sales before the Beneficiary Organization's 75% share is ever calculated. The following shows exactly how many tickets must be sold before Give & Go's fee is fully covered โ€” demonstrating that there is zero financial risk to the Beneficiary Organization at any ticket count above the minimum:

How to read this table: The "Tickets to Cover Fee" column shows how many tickets need to be sold before Give & Go's entire platform fee is fully recovered from revenue โ€” at which point every additional ticket sold generates 75 cents on the dollar directly for the Beneficiary Organization. At the 250-ticket minimum, Give & Go's fee has long been covered and the Beneficiary Organization is receiving its full 75% share. There is no scenario at or above the minimum ticket threshold where the Beneficiary Organization loses money or fails to receive its guaranteed minimum payout.
Payment Processing Fees: Give & Go uses Stripe for secure payment processing. At checkout, each entrant is asked to voluntarily absorb the Stripe transaction fee associated with their purchase. If an entrant elects not to cover the processing fee, Give & Go absorbs that fee entirely โ€” it is never deducted from the Beneficiary Organization's share. The organization's 75% payout is always calculated on the full gross ticket revenue before any processing fee consideration.
Peak Season Pricing โ€” Fixed at Campaign Launch: Give & Go sets all prize costs using permanent peak season rates at campaign launch. These rates are fixed for the life of the campaign and do not change regardless of when the winner travels or what the actual fulfillment cost turns out to be. The Beneficiary Organization receives 75% and Give & Go receives 25% of net revenue after the fixed prize cost is deducted โ€” always calculated against the same fixed rate established at launch, with no adjustments in either direction.
Note on entry fees: Payments made to enter Give & Go sweepstakes are payments for sweepstakes entry and are not charitable donations. Entrants may not claim any portion of their entry fee as a charitable deduction on their federal or state tax returns.
Section 11
Minimum Entry Threshold & Campaign Duration

Each campaign tier has a minimum number of entries required before a drawing may be conducted:

  • Gold Tier: Minimum 250 entries ยท Maximum 400 entries
  • Platinum Tier: Minimum 250 entries ยท Maximum 350 entries
  • Diamond Tier: Minimum 250 entries ยท Maximum 300 entries
Campaign Duration โ€” 60 Days Standard ยท 30-Day Extension ยท 90 Days Maximum

All Give & Go campaigns operate on the following timeline:

Standard Campaign Period โ€” 60 days
Every campaign launches with a standard 60-day active period. This provides ample time for the Beneficiary Organization to promote the campaign across its community, social media channels, email lists, and events. Give & Go recommends treating day 45 as a natural "last chance" push milestone to maximize ticket sales before the final two weeks.

30-Day Extension โ€” if minimum not yet met
If the minimum ticket threshold has not been reached by the standard campaign close date (day 60), Give & Go will automatically grant one (1) extension of thirty (30) additional days. Give & Go will notify all existing entrants by email on day 60 that the campaign has been extended and is entering its final 30-day window. Give & Go will work directly with the Beneficiary Organization during this period to discuss strategy and next steps. This extension serves as a natural marketing event โ€” a "final push" that often drives significant additional ticket sales as supporters respond to urgency.

Maximum Campaign Duration โ€” 90 days total
No campaign may remain active for more than 90 calendar days from its original launch date under any circumstances. If the minimum ticket threshold has not been met by day 90, Give & Go will consult directly with the Beneficiary Organization to determine the best path forward. Give & Go will work with the organization on next steps including communications to existing entrants. Any outcome will be handled on a case-by-case basis in consultation with the Beneficiary Organization and in accordance with applicable law.

Maximum Ticket Cap โ€” automatic close
If a campaign reaches its maximum ticket cap (400 Gold / 400 Platinum / 400 Diamond) before the 60-day close date, the campaign closes immediately at that point and the drawing is scheduled within seven (7) days. No additional entries will be accepted once the maximum is reached.

Give & Go will send automated reminder emails to the Beneficiary Organization at campaign day 30, day 45, day 55, and day 60, providing current ticket count, funds raised, and promotional guidance to help reach minimum thresholds. Give & Go's campaign support team is available to assist any organization that is struggling to reach its minimum within the standard period.

Section 12
Void Where Prohibited

This sweepstakes is void in the following states and jurisdictions and wherever else prohibited or restricted by applicable law:

Give & Go makes no representation that participation in this sweepstakes is appropriate or lawful in all locations. Entrants are responsible for determining whether their participation complies with the laws of their jurisdiction. Give & Go reserves the right to restrict entry from any state or jurisdiction at any time.

Florida and Rhode Island residents: Sweepstakes with prize values exceeding $5,000 may be subject to registration and bonding requirements under Florida Statutes and Rhode Island law. Give & Go complies with all applicable registration requirements before accepting entries from residents of those states.

Section 13
Taxes, Reporting & Prize Valuation Methodology

All federal, state, and local taxes on prizes are the sole responsibility of the winner. The IRS treats sweepstakes prizes as ordinary income โ€” the Approximate Retail Value (ARV) of the prize is added to the winner's gross income for the tax year in which the prize is received. Winners may be required to provide a valid Social Security Number or Tax Identification Number for tax reporting purposes prior to prize fulfillment.

Give & Go will issue an IRS Form 1099-MISC to winners of prizes with an Approximate Retail Value of $600 or more, as required by applicable federal law. All three Give & Go prize tiers exceed this threshold. Winners are responsible for reporting prize income on their federal and applicable state income tax returns.

Give & Go Prize Valuation Methodology โ€” How We Determine Taxable ARV

Give & Go applies a careful, documented, and professionally supported methodology when establishing the Approximate Retail Value reported on IRS Form 1099-MISC. Several factors meaningfully reduce the true taxable fair market value of these prizes below the published peak rack rate, and Give & Go accounts for all of them:

1. Membership-Based Pricing & Deep Market Discounts
Give & Go accesses Palace Resorts inventory through a private membership program. This reflects the reality that all-inclusive Mexican and Caribbean resort packages are virtually never sold at published rack rates. Major travel platforms including Expedia, Booking.com, Costco Travel, and AAA Travel routinely offer the same Palace Resorts properties at 30โ€“60% below published rates. The IRS standard for Fair Market Value is the price a willing buyer would pay a willing seller in an arms-length transaction โ€” and that price is consistently and substantially below rack rate. Off-peak travel periods further reduce actual market pricing, often by 40โ€“55% compared to peak season published rates. Give & Go's valuation methodology therefore applies a documented off-peak market rate adjustment, reducing the effective base value to approximately 50% of the published peak ARV as a defensible reflection of actual real-world market pricing.

2. Foreign Country โ€” No US Domestic Equivalent Market
All Give & Go prizes are located outside the United States โ€” in Mexico, Jamaica, the Dominican Republic, and other international destinations. These properties are not subject to US domestic pricing standards and operate in foreign hospitality markets where promotional pricing, occupancy-based discounting, and heavy package bundling are the commercial norm. There is no US domestic equivalent market for these products, which further supports a valuation based on actual transacted market prices rather than foreign rack rates.

3. Food, Beverage & Non-Lodging Bundle Components โ€” 50% Allocation
The Give & Go prize is not lodging alone โ€” it is a comprehensive all-inclusive bundle. A substantial and documented portion of an all-inclusive resort package consists of food, beverage, and entertainment components that are non-transferable consumable services with no cash-equivalent or residual value. The winner cannot sell their meals, bottle service, room service orders, or nightly entertainment access. Once consumed, these benefits cease to exist as economic assets. Industry analysis of all-inclusive resort pricing consistently indicates that food, beverage, and entertainment components represent approximately 50% or more of the total all-inclusive package value. Give & Go therefore applies a 50% food, beverage, and non-lodging allocation to its adjusted base value, recognizing that only the lodging component represents a genuine transferable economic benefit subject to fair market value taxation. The remaining 50% โ€” representing unlimited meals, premium open bar, entertainment, activities, and resort amenities โ€” is treated as non-transferable consumable services in Give & Go's ARV calculation.

4. Resulting Taxable ARV โ€” Give & Go's Good-Faith Documented Position
Applying the off-peak market rate adjustment (approximately 50% of published peak ARV) and the 50% food, beverage, and non-lodging allocation to the adjusted base, Give & Go arrives at a taxable lodging ARV of approximately 25% of the published peak campaign price for each tier. These figures represent Give & Go's reasonable, good-faith, documented determination of the taxable fair market value of the lodging component of each prize โ€” not the maximum possible published rack rate โ€” and form the basis of the 1099-MISC issued to winners.

This is Give & Go's contribution to helping winners enjoy their prize without an unexpected tax burden, and is part of Give & Go's ongoing commitment to giving back to the communities and individuals that make our platform possible.

Section 14
Limitation of Liability

By entering, each entrant agrees to release, discharge, and hold harmless Give & Go, its officers, directors, employees, agents, successors, and assigns, and the Beneficiary Organization, from and against any and all claims, damages, losses, costs, or expenses arising out of or in connection with participation in the sweepstakes or the acceptance, use, or misuse of any prize.

Give & Go is not responsible for: lost, late, misdirected, illegible, damaged, or incomplete entries; technical failures of any kind; unauthorized human or machine intervention; printing or typographical errors; or any other errors or problems in connection with this sweepstakes.

Give & Go reserves the right to cancel, suspend, or modify the sweepstakes if fraud, technical failure, or any other factor beyond Give & Go's reasonable control compromises the integrity of the sweepstakes, as determined by Give & Go in its sole discretion.

Section 15
Disputes & Governing Law

These Official Rules and all aspects of this sweepstakes shall be governed by the laws of the United States and the state of New Jersey, without regard to conflicts of law principles. Any dispute arising out of or relating to this sweepstakes shall be resolved exclusively through binding individual arbitration, and each entrant waives the right to participate in any class action lawsuit or class-wide arbitration in connection with this sweepstakes.

All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules shall be governed by and construed in accordance with the laws of New Jersey.

Section 16
General Conditions & Fraud Prevention

By entering this sweepstakes, each entrant agrees to be bound by these Official Rules and the decisions of Give & Go, which are final and binding in all matters relating to this sweepstakes. Give & Go reserves the right to disqualify any entrant who tampers with the entry process, acts in a disruptive manner, or violates these rules.

A list of confirmed winners will be available upon request by sending a self-addressed stamped envelope to the Give & Go mailing address listed above within ninety (90) days of the campaign close date.

These Official Rules may be updated from time to time. The most current version will always be available at giveandgo.com/rules. Continued participation following any update constitutes acceptance of the revised rules.

If any provision of these Official Rules is found to be invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.

Fraud, Abuse & Disqualification

Give & Go maintains a zero-tolerance policy toward fraud, abuse, and manipulation of any sweepstakes campaign. The following conduct will result in immediate and permanent disqualification, forfeiture of all entries and prizes, and may result in civil or criminal referral:
  • Submission of false, fabricated, or fraudulent mail-in entries including mass-produced, mechanically reproduced, or third-party assisted entries
  • Use of bots, scripts, automated systems, or any non-human method to generate entries
  • Creation of multiple accounts, false identities, or fictitious entrants
  • Tampering with the entry pool, drawing process, or any aspect of campaign administration
  • Collusion between entrants, Beneficiary Organizations, or any third party to manipulate results
  • Submission of false eligibility information including age, residency, or identity
  • Any attempt to claim a prize through misrepresentation, impersonation, or fraudulent documentation
Give & Go reserves the right to audit any campaign entry at any time and to void entries that cannot be verified as legitimate. In the event fraud is discovered after a prize has been awarded, Give & Go reserves the right to void the award and require return of the prize or its equivalent cash value.
Section 17
Publicity Rights & Winner Verification

By accepting a prize, each winner grants Give & Go a perpetual, irrevocable, royalty-free, worldwide license to use their name, photograph, likeness, voice, hometown, state of residence, and any statements made by or about the winner in connection with any Give & Go sweepstakes campaign for any promotional, advertising, marketing, or public relations purpose, in any medium now known or hereafter developed, including but not limited to:

  • Give & Go website, campaign pages, and digital platforms
  • Social media channels including Facebook, Instagram, TikTok, YouTube, and all other platforms
  • Email marketing and newsletters
  • Press releases, media outreach, and earned media
  • Print, digital, and broadcast advertising
  • Presentations, trade shows, and promotional events

This grant of publicity rights is made without additional compensation to the winner and without further consent required, except where prohibited by applicable law. Winners in states that prohibit the use of a winner's name or likeness for commercial purposes without additional consent will be contacted separately.

Winner Identity Verification: Prior to prize fulfillment, winners must provide a copy of a valid, unexpired government-issued photo ID confirming their legal name, age, and state of residence. Acceptable forms of ID include a US passport, US driver's license, or US state-issued ID card. Failure to provide acceptable ID within ten (10) business days of request will result in forfeiture of the prize and selection of an alternate winner.

Winners may also be required to execute an Affidavit of Eligibility and a Liability Release prior to prize fulfillment. These documents must be returned within ten (10) business days of receipt. Failure to return completed documents constitutes forfeiture.

Section 18
Winner Forfeit, Non-Response & Prize Expiration

A prize is deemed forfeited and Give & Go is released from all prize obligations under any of the following circumstances:

  • Winner fails to respond to initial winner notification within five (5) business days of the first contact attempt
  • Winner fails to provide required identity documentation within ten (10) business days of request
  • Winner fails to return required Affidavit of Eligibility or Liability Release within ten (10) business days of receipt
  • Winner fails to select resort and travel dates within thirty (30) days of receiving Winner Portal access
  • Winner fails to complete travel within twelve (12) months of the campaign close date
  • Winner is found to be ineligible under these Official Rules at any point in the process
  • Winner declines or refuses the prize for any reason
  • Winner is found to have committed fraud or misrepresentation in connection with their entry
Reminder notifications: Give & Go will send automated reminder notifications to the winner at day 20 and day 28 of the 30-day date selection window. At day 28, a final notice will be sent stating that the prize will be forfeited in 48 hours if dates are not selected. No prize will be forfeited without this advance notice having been sent to the winner's email address on file. Give & Go is not responsible for winner notifications going to spam, being blocked, or otherwise not being received due to the winner's email settings or service provider.

In the event of forfeiture, Give & Go reserves the right to select an alternate winner from the original campaign entry pool, award the prize in a future campaign, or return the prize week to Give & Go's inventory at its sole discretion. No cash compensation will be offered in lieu of a forfeited prize under any circumstances.

Section 19
Resort Substitution, Blackout Dates & Prize Modifications

Give & Go fulfills all prizes through its Palace Resorts membership program. While Give & Go makes every reasonable effort to fulfill prizes exactly as described on campaign pages, the following substitution and modification rights are reserved:

Resort Substitution: If a specific Palace Resorts property becomes unavailable due to closure, natural disaster, renovation, loss of certification, force majeure, or any other reason between campaign launch and winner travel, Give & Go will substitute an alternative Palace Resorts property of comparable or superior quality at Give & Go's sole discretion. The winner will be offered a selection of available alternative properties through the Winner Portal. If no suitable Palace Resorts alternative is available, Give & Go will substitute a comparable all-inclusive resort of equivalent or greater value at the same destination or an agreed alternative destination. No cash alternative will be offered unless no suitable substitute resort is available.

Suite Type Substitution: Suite types are subject to availability at the winner's selected property and dates. If the exact suite type described in the campaign prize is unavailable, Give & Go will substitute a comparable or upgraded suite at the same property. If no comparable suite is available, Give & Go will offer an alternative property where the suite is available. Winners may not select travel dates on which their prize suite type is not available without accepting a substitution.

Blackout Dates: The following date categories are subject to blackout and may not be available for winner travel:
  • Major US and Mexican public holidays including Christmas, New Year's, Thanksgiving, spring break peak weeks, and US federal holidays
  • Peak season periods as designated by Palace Resorts, typically mid-December through early January and the months of March and July
  • Dates on which Give & Go's membership inventory for the specific property is already committed
  • Any dates on which the selected resort is at capacity or has restricted availability
Current blackout dates for each available property are displayed in the Give & Go Winner Portal at the time of date selection. Blackout dates are subject to change and Give & Go does not guarantee availability on any specific date outside of blackout periods. Winners are encouraged to have multiple preferred date options when accessing the Winner Portal.
Section 20
Beneficiary Organization Promotion Requirements

By registering a campaign on the Give & Go platform, the Beneficiary Organization agrees to actively promote its campaign throughout the campaign period. Minimum promotional requirements include:

  • A minimum of two (2) social media posts per week on at least one active organizational social media account (Facebook, Instagram, or equivalent) during the active campaign period, featuring the campaign link and prize details
  • At least one (1) direct email or newsletter communication to the organization's supporter list announcing the campaign within the first fourteen (14) days of launch
  • Display of the campaign link on the organization's website or primary digital presence within fourteen (14) days of launch, where applicable
  • Active promotion of the campaign at any in-person meetings, events, games, or gatherings held during the campaign period
Failure to meet minimum promotional requirements may result in campaign suspension, reduced priority for future campaigns, or removal from the Give & Go platform at Give & Go's sole discretion. Give & Go reserves the right to monitor campaign promotional activity and to contact the Beneficiary Organization if promotional activity appears insufficient. Give & Go's inventory is finite โ€” organizations that commit a prize week and fail to actively promote their campaign deprive other organizations of the opportunity to use that week. Active promotion is not optional.

Give & Go will provide Beneficiary Organizations with a complete social media toolkit upon campaign launch, including pre-written posts, shareable graphics, email templates, and promotional guidance. Organizations are encouraged but not required to use these materials.
